工作许可延期及变更 办事指南(试行)
一、法定依据
(一)《中华人民共和国行政许可法》。
(二)《中华人民共和国出境入境管理法》第四十一条规定:外国人在中国境内工作,应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。
(三)《中华人民共和国外国人入境出境管理条例》第七条规定:申请R字签证,应当符合中国政府有关主管部门确定的外国高层次人才和急需紧缺专门人才的引进条件和要求,并按照规定提交相应的证明材料。申请Z字签证,应当按照规定提交工作许可等证明材料。
第十六条规定:工作类居留证件,应当提交工作许可等证明材料;属于国家需要的外国高层次人才和急需紧缺专门人才的,应当按照规定提交有关证明材料。
(四)《国务院对确需保留的行政审批项目设定行政许可的决定》(国务院令第412号),第93项:外国人入境就业许可;第443项:外国专家来华工作许可。
(五)国务院审改办《关于整合外国人来华工作许可事项意见的函》(审改办函〔2015〕95 号)。
二、申请条件
(一)基本条件
1.申请人应年满18周岁,身体健康,无犯罪记录,境内有确定的合法用人单位,具有从事其工作所必需的专业技能或相适应的学位。
2.申请人为国内急需紧缺的专业人员,所从事的工作符合我国经济社会发展需要。
3.法律法规对外国人来华工作另有规定的,从其规定。
(二)外国高端人才(A类)
外国高端人才是指符合“高精尖缺”和市场需求导向,中国经济社会发展需要的科学家、科技领军人才、国际企业家、专门特殊人才等,以及符合计点积分外国高端人才标准。外国高端人才可不受年龄和工作经历限制。
(三)外国专业人才(B类)
外国专业人才是指符合外国人来华工作指导目录和岗位需求,以及符合计点积分外国专业人才标准,应当不超过60 周岁,具有学士及以上学位和2 年及以上相关工作经历;确有需要的,可适当放宽年龄、学位或工作经历等限制。
(四)外国普通人员(C类)
外国普通人员是指满足国内劳动力市场需求,从事符合国家政策规定的临时性、季节性、非技术性或服务性工作。
三、办理流程
(一)正常办理流程
1.网上申请。用人单位登录“外国人来华工作管理服务系统”,在线提交申请信息,并提供相关电子材料。委托专门服务机构现场提交材料的,需在线登记专门服务机构名称、合法登记证明(营业执照或组织机构代码证、社会保险登记证或外国企业常驻代表机构登记证等)经办人姓名、身份证件、联系电话等,并现场提交用人单位委托书、经办人身份证明。
2.网上预审。成都市外国专家局(以下简称“市外专局”)应当在5个工作日内对网上提交的材料进行预审。材料不齐全、内容不规范的,受理机构应当一次性在线告知需补正材料;材料齐全、内容规范的,在线通知或预约现场提交材料。
3.受理。市外专局审查后决定是否受理。申请事项属于本行政机关职权范围,申请材料齐全、符合要求的,应当当场予以受理,市外专局出具加盖专用印章和注明日期的《外国人来华工作许可受理单》;申请材料不齐全或不符合法定形式的,应当当场告知需补正内容,并出具一次性告知书,补正后予以受理;不属于本行政机关职权范围的、不具备申请条件的,由市外专局出具加盖专用印章的不予受理通知书,说明不予受理的理由和依据,并自接收纸质材料之日起5日内送达申请人或用人单位。
4.审查。提交材料核验后,市外专局应当在10个工作日内进行审查并作出决定。
5.决定。符合条件、标准的,市外专局作出准予行政许可决定;不符合条件、标准的,作出不予许可书面决定,说明理由,并告知申请人或用人单位享有依法申请行政复议或者提起行政诉讼的权利。
市外专局可根据用人单位及申请人信用记录情况,简化外国人来华工作许可延期申请的纸质材料核验环节。
(二)外国高端人才(A类)申请外国人来华工作许可延期的,提供如下便利措施:
1.受理机构网上预审通过的直接受理,给予受理电子回执单。申请人入境前不需提供纸质材料进行核验。
2.入选国内相关人才计划的外国高端人才,全流程在线办理,无需提交纸质材料核验。
四、申请材料
(一)申请外国人来华工作许可延期
用人单位在原岗位(职业)继续聘用申请人的,应当在申请人的来华工作许可有效期届满三十日前向决定机构提出申请,但不得早于许可有效期届满前九十日。

(二)申请外国人来华工作许可变更
申请人个人信息(姓名、护照号、职务、类别)等事项发生
变更的,应当自变更事项发生之日起10 日内向许可决定机构提出申请。

五、办结时限
如无特殊情况,网上申请审批时限5个工作日,纸质材料自受理之日起10个工作日办结。
六、审批收费依据及标准
不收费。
七、审批结果
决定机构作出许可决定后,应当通过“外国人来华工作服务管理系统”公告方式通知用人单位。批准的,申请人或用人单位在线打印《外国人工作许可通知》,领取准予许可书面决定和《外国人工作许可证》;未批准的,用人单位领取不予许可书面决定。
1. Legal basis
(1) Law of the People’s Republic of China on Administrative Licensing.
(2) Article 41 of the “Administrative Law on Exit and Entry of the People’s Republic of China” stipulates that foreigners working in China must obtain work permits and work permits in accordance with regulations. No unit or individual may employ foreigners who have not obtained work permits and work permits.
(3) Article 7 of the “Regulations on the Administration of Entry and Exit of Foreigners of the People’s Republic of China” stipulates that the application for an R visa shall meet the conditions and requirements for the introduction of foreign high-level talents and urgently needed specialized talents as determined by the relevant competent authorities of the Chinese government, and Provision of corresponding certification materials is required. To apply for a Z visa, proof of work permits and other documents should be submitted in accordance with regulations.
Article 16 stipulates that work-type residence permits shall be submitted with supporting documents such as work permits; those belonging to high-level foreign talents in need of the state and urgently needed specialized talents shall submit relevant certification materials in accordance with regulations.

Application conditions
(1) Basic conditions
1. The applicant should be over 18 years of age, be in good health, have no criminal record, have a certain legal employer in the country, and have the necessary professional skills or a suitable degree to perform his work.
2. The applicant is an urgently needed professional in China, and the work they are doing meets the needs of China’s economic and social development.
3. Where laws and regulations provide otherwise for foreigners to work in China, such provisions shall prevail.
(2) Foreign high-end talents (Class A)
Foreign high-end talents refer to scientists, leading science and technology talents, international entrepreneurs, special special talents, etc. that meet the “high-skill shortage” and market demand-oriented requirements of China’s economic and social development, as well as qualifying foreign high-end talent points. Foreign high-end talents are not restricted by age and work experience.
(3) Foreign Professionals (Class B)
Foreign professional talents refer to the directory of foreigners working in China and the requirements of positions, and to meet the points of foreign professional talents points, should be under 60 years old, have a bachelor’s degree or above and 2 years or more related work experience; there is a need , The restrictions on age, degree, or work experience may be appropriately relaxed.
(4) Ordinary foreign personnel (Category C)
Ordinary foreign workers are those who meet the needs of the domestic labor market and engage in temporary, seasonal, non-technical or service work in accordance with national policies.
Third, the process
(I) Normal application process
1. Apply online. The employer shall log in to the “Foreigner Work Management Service System in China”, submit application information online, and provide relevant electronic materials. When entrusting a special service agency to submit materials on-site, the name of the special service agency, legal registration certificate (business license or organization code certificate, social insurance registration certificate, or registration certificate of the resident representative office of a foreign enterprise, etc.) must be registered online. Documents, contact numbers, etc., and submit the power of attorney of the employer and the identity certificate of the manager on the spot.
2. Online pre-trial. The Chengdu Foreign Experts Bureau (hereinafter referred to as the “Municipal Foreign Experts Bureau”) shall conduct a pre-review of the materials submitted online within 5 working days. If the materials are incomplete and the content is not standardized, the accepting agency shall notify the materials to be corrected online once; if the materials are complete and the content is standardized, the online notification or appointment shall be submitted on-site.
3. Acceptance. The Municipal Foreign Experts Bureau shall decide whether to accept the application after examination. The application matters are within the scope of this administrative organ’s authority. If the application materials are complete and meet the requirements, they shall be accepted on the spot. The Municipal Bureau of Foreign Affairs shall issue a special seal and dated “Receipt of Acceptance of Work Permit for Foreigners to China”; the application materials are not If it is complete or does not meet the legal form, it shall be notified on the spot of the content that needs to be corrected, and a one-time notification letter shall be issued and accepted after the correction; if it does not fall within the scope of the administrative authority and does not meet the application requirements, it shall be issued with a stamp The non-acceptance notice of the special seal, explaining the reasons and basis for the inadmissibility, and delivered to the applicant or the employer within 5 days from the date of receipt of the paper materials.
4. Review. After the submitted materials are verified, the Municipal Bureau of Foreign Experts Affairs shall review and make a decision within 10 working days.
5. Decision. If it meets the conditions and standards, the Municipal Bureau of Foreign Experts Affairs makes a decision to grant an administrative license; if it does not meet the conditions and standards, it makes a written decision to disapprove, explain the reasons, and inform the applicant or the employer that it is entitled to apply for administrative reconsideration or file an administrative lawsuit. right.
The Municipal Bureau of Foreign Experts Affairs may simplify the verification of paper materials for applications for extension of work permits for foreigners to China based on the credit records of the employer and the applicant.
(2) If foreign high-end talents (Class A) apply for extension of work permit for foreigners to China, the following convenience measures are provided:
1. The direct acceptance of the online pre-examination by the accepting agency will give an acceptance electronic receipt. Applicants do not need to provide paper materials for verification before entering the country.
2. The foreign high-end talents selected into the domestic related talent plan are handled online in the entire process, and there is no need to submit paper materials for verification.
Application materials
(1) Application for Extension of Work Permit for Foreigners to China
If the employer continues to hire the applicant in its original position (occupation), it shall apply to the decision-making agency 30 days before the expiry of the validity of the work permit for the applicant in China, but no earlier than 90 days before the expiry of the validity of the permit.

Remarks:

(2) Application for Change of Work Permit for Foreigners to China
Applicant’s personal information (name, passport number, job title, category), etc.
In case of a change, an application shall be submitted to the license decision body within 10 days from the date of the change.

Remarks:

5. Time limit for closing
If there are no special circumstances, the time limit for online application approval is 5 working days, and the paper materials will be completed within 10 working days from the date of acceptance.
6. Basis and Standards for Approval Fees
No charge.
Seven, approval results
After the decision-making agency makes a decision on the permit, it shall notify the employer by means of the “foreign work in China service management system” announcement. If approved, the applicant or employer prints the “Foreigner Work Permit Notice” online, and obtains the written decision to approve the permit and the “Foreigner Work Permit”; if it is not approved, the employer obtains the written decision of no permit.
